Privacy policy (GDPR)

1. Introduction

This privacy policy describes how RECAP – Real Estate Capital SRL, with registered office at Avenue Louise 231, 1050 Brussels, processes personal data in connection with its real estate activities and the operation of the website www.re-capital.be.

RECAP undertakes to comply with Regulation (EU) 2016/679 of 27 April 2016 (the General Data Protection Regulation – GDPR) and the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.

3. Data collected

We only collect the data strictly necessary to manage our activities, including:

• Identification and contact data : surname, first name, address, email, phone number, etc.
• Data relating to rental or purchase applications : employment status, income, household composition, property preferences, etc.
• Browsing data : IP address, browser type, pages visited, via cookies (see section 11).
• Data from real estate partners (e.g. Immoweb, Immovlan, Zimmo) when you have expressly agreed to your details being passed on through their forms.

4. Purposes of processing

Your data is processed for the following purposes:

• Organising and following up property viewings and managing rental or purchase applications ;
• Administrative, accounting and contractual management of lettings, sales and mandates ;
• Providing information or offers about our real estate services ;
• Passing on your details to the owners of the properties you enquired about, in accordance with the IPI code of ethics;
• Improving the quality of our services and compiling internal statistics;
• Sending, with your consent, newsletters or information about similar properties;
• Compliance with our legal obligations (tax, accounting, anti-money laundering, etc.).

5. Legal bases for processing

In accordance with Article 6 GDPR, our processing is based on the following legal grounds:

• Performance of a contract or pre-contractual measures (handling an application, drawing up a lease, a sale, etc.);
• Explicit consent (e.g. subscribing to our newsletter or receiving similar offers);
• Legal obligation (e.g. accounting, tax and anti-money laundering obligations);
• Legitimate interest of RECAP (service improvement, internal management, website security).

6. Recipients of the data

The data is only accessible to RECAP staff and, where applicable, certain service providers or processors(hosting provider, accountant, IT provider, etc.), who are bound by a strict duty of confidentiality.

Your data will never be sold or disclosed to third parties for commercial purposes without your explicit consent.

7. Transfers of data outside the European Economic Area (EEA)

Some data may be processed by technical service providers (e.g. hosting, analytics tools, messaging) located outside the EEA.

In that case, RECAP ensures that these providers offer appropriate safeguards, in particular through the standard contractual clauses approved by the European Commission.

8. Retention period

• Rental or purchase applications : 12 months after the last interaction, unless you consent to longer retention.
• Contractual, accounting or legal documents : 7 to 10 years in accordance with legal obligations.
• Contact data for marketing purposes : until consent is withdrawn.
• Cookies and browsing data : for the period set out in the cookie policy (see section 11).

After these periods, the data is deleted or anonymised.

9. Rights of data subjects

You have the following rights:

• Right of access to your data;
• Right to rectification of inaccurate data;
• Right to erasure ("right to be forgotten");
• Right to restriction of processing;
• Right to data portability;
• Right to object to processing, in particular for marketing communications.

To exercise your rights, send a written request to rgpd@re-capital.be.

You will receive a reply within one month at the latest, in accordance with Article 12 GDPR.

If you believe your rights are not being respected, you can lodge a complaint with the Data Protection Authority (www.dataprotectionauthority.be).

10. Data security

RECAP implements all necessary technical and organisational measures to protect your data against loss, destruction, unauthorised access or improper disclosure.

Our employees and partners are bound by a strict duty of confidentiality.

11. Cookies

a) What is a cookie?

A cookie is a small file stored on your device when you visit a website. It allows certain preferences to be kept (language, display, session, etc.).

b) Types of cookies used

• Strictly necessary cookies : ensure the website works (session, security).
• Analytics cookies : measure traffic and use of the site (e.g. Google Analytics).
• Marketing cookies : personalise content and offers (with your explicit consent).

c) Consent and management

On your first visit, a consent banner allows you to accept or refuse non-essential cookies.

13. Governing law

This policy is governed by Belgian law.
